大樋長楽 · 大樋長左衛門

The bloodline of the founder of the 大樋焼 kiln ended with the seventh generation in 1894.
After that, two families outside the bloodline each claimed to be the heir. The dispute went to court three times, and in 2003 the court ruled that no one had lawfully succeeded.

01 · Overview

Four scenes to know

The whole story fits into four moments, from a kiln under a daimyō's patronage to a judgment that let no one win.

1666

A kiln is founded in 大樋村 (Ōhi-mura)

A potter trained under the Raku family followed the tea master 仙叟宗室 (Sensō Sōshitsu) to Kanazawa at the invitation of the daimyō 前田綱紀 (Maeda Tsunanori)

1894

Gen 7, 道忠 (Dōchū), dies

His descendants were poor and were adopted into other families; no one carried on the craft. The court treats the main kiln as ending here.

1894 · 1930

Two families step in

The disciple 奈良理吉 (Nara Rikichi) carried the name on as "Gen 8", while the potter 大樋長楽 began using his name around 1930

2003

The court finds no rightful heir

Both sides may keep their current names, but neither is the "本家" (honke, main house), the lawful successor

Fired in a small kiln, then pulled out to cool fast
手捏ね・箆削り (tezukune, hera-kezuri), no wheel

The founding 1

  • In 1666 (寛文6, Kanbun 6) 前田綱紀, daimyō of the Kaga domain, invited 仙叟宗室, fourth head of Urasenke, to Kanazawa
  • The potter 土師長左衛門 (Haji Chōzaemon), a pupil of 一入 (Ichinyū), fourth-generation Raku, came with him and set up a kiln in 大樋村, which gave him the surname 大樋
  • The founder was born in 1631 in Haji village, Kawachi province, and studied in Kyoto from 1656 3
  • Sources disagree on when the kiln was built: the dealer 天平堂 (Tenpyōdō) says 1686, the year 仙叟 returned to Kyoto 4
  • Raku technique: shaped by hand and pared with a spatula (手捏ね・箆削り), no wheel; fired in a small kiln, then pulled out to cool fast
  • Its hallmark is the amber glaze 飴釉. There are two versions of where it came from: the Raku family "gave" it 2, or Raku "forbade black and red", so the potter devised his own 4, a version with no institution-level evidence behind it
戊 · 己 adopted into other families

The decline, 1884–1910 1

After the Meiji Restoration the kiln lost its 御庭焼 (oniwa-yaki) status and had to support itself, just as the tea world went into decline. In 1884 the kiln was set up again in 春日町 (Kasuga-machi), but mainly made braziers and charcoal stoves 3. The court record does not mention war or soldiers; the causes were poverty and the adoption of the children into other families.

  • 17 May 1886The eldest child, 戊, is adopted into another family
  • 6 Oct 1894道忠 dies, aged 61
  • 14 Nov 1907己 is adopted out; the Ōhi household is abolished in the register
  • 9 Feb 1910The Ōhi household is re-established in the register

What the court saidThe kinship story is false and probably the product of deliberate distortion; the court believed that around 1901–02 the impoverished guardian of 己 sold the family tree to 理吉 1"八代" first appears in a pamphlet around 1994, after 長楽's death; the court called it newly "created" (創作, sōsaku) 1

Born in Kanazawa. After graduating from the ceramics department of the prefectural industrial school (the same school as Gen 9 of the Nara side), he began researching around 1924 and, self-taught, succeeded in reviving the long-lost white curtain glaze 大樋白幕釉. He also made three-color glaze, 三彩釉 (sansai-yū).

More details

  • Gen 9 of the Nara side: real name 長次郎; received the art name 陶土斎 from 鵬雲斎 (Hōunsai) in 1977 or 1978 4. Sources disagree on the year he took the name: the museum says 1927, several dealers say 1934
  • Gen 10: his father's will directed "十代目大樋長左衛門を襲名させる" (have him succeed as the tenth Ōhi Chōzaemon); in Jan 1987 he received a certificate from the 今日庵主 (Konnichian-shu, head of Urasenke) and in Feb 1987 sent letters announcing his succession · 日本芸術院賞 (Japan Art Academy Prize) 1985 · member of the 日本芸術院 1999 1
  • 村田元雄: graduated from 金沢工業専門学校 (Kanazawa Kōgyō Senmon Gakkō) in 1948 · received the name from "大樋宗家直系 九代大樋知邦" in 1986 · member of the 日本工芸会 (Nihon Kōgeikai, Japan Kōgei Association) from 2002, unconfirmed 4
  • The Murata shop: the prefectural website says it sells the work of three generations, 長楽 · 勘兵衛 · 朔芳 2; it hung a "本窯元大樋焼" (Hon-kamamoto Ōhi-yaki) shop curtain around 1965 and registered the trade name "大樋焼本家窯元" on 2 Feb 1987 1
  • A blog's claim that 長楽 was a "direct descendant of 道忠" contradicts the court, which lists 道忠's descendants in full without 長楽

The settlement of 24 Mar 1992

    • ●年朗 (Nara) accepts that Gen 1 to 7 are the ancestors of 丙 and will not suggest that he has any blood connection to them
    • ●丙 (bloodline) does not object to 年朗 and his descendants using the name "大樋長左衛門"
    • ●Murata must stop using "大樋長左衛門" by 11 Feb 1995 and may choose one new name; he later chose 勘兵衛

北國新聞 (Hokkoku Shimbun), 24 Mar 1992, headline "2人長左衛門騒動が和解" · the 10 Apr issue reported that the Ōhi-yaki potters' cooperative had split and could not be reunited 2

What each side asked for in Round 3

    The plaintiff (Nara) asked for

The defendant to be barred from using "大樋焼本家窯元" · "九代(目)大樋勘兵衛" · "前大樋長左衛門(長)" (former Ōhi Chōzaemon, Hisashi) · a bar on calling 長楽 "八代目" · cancellation of the trade-name registration · a published apology · 50 million yen in damages plus 5% annual interest from 1 Aug 1993

    The defendant (Murata) counterclaimed for

The plaintiff to be barred from interfering · the plaintiff to be barred from using "十代目大樋長左衛門" · 50 million yen in damages with interest from 17 Jun 1995

This was not a registered-trademark (商標, shōhyō) case but one about trade names (商号, shōgō) and indications of goods

The appeal court judgment, Mar 2003 1

Nagoya High Court, Kanazawa Branch, First Division; judges 川崎和夫 (presiding), 榊原信次 and 渡邉和義. The court set aside the first-instance judgment and decided the case anew.

    What the Nara side got
    • ✓May keep using "十代大樋長左衛門"; the court did not bar it
    • ✓The defendant is barred from using "前大樋長左衛門(長)" because it breaches clause (ウ) of the 1992 agreement
    • ✕All other claims dismissed, including the 50 million yen in damages
    What the Murata side got
    • ✓May keep using "大樋焼本家窯元" and "九代(目)大樋勘兵衛", and the plaintiff is barred from interfering
    • ✕Barred from using "前大樋長左衛門(長)"
    • ✕The claims to bar the plaintiff from using "十代目大樋長左衛門" and for 50 million yen in damages were dismissed

The 大樋焼 main kiln, with the first generation as its founder, came to an end with the seventh generation, 道忠; after that, no one can be recognized as having lawfully succeeded to its line of work and its name.

The key holding of the judgment

One is free to take whatever pride in oneself one likes, but one may not force others to accept that belief.

The sentence in which the court rebuked the plaintiff

    The bloodline's rights

The court held that heirs who did not carry on the craft themselves have no power to let others succeed to the name, so 丙's endorsement in 1986 had no legal effect

    On "八代"

The court found that the Murata side made 長楽 the eighth generation in the same way the Nara side had "staged" 奈良理吉 as the eighth

    Court costs

Item 6 of the 主文 (shubun, operative part) splits the costs of both instances into two shares, one for each side

    After the case

    • No record of a further appeal has been found, nor any report of a reconciliation
    • The two lines still work separately, Nara in 橋場町 and Murata in 南町, and both still use the word "本家"
    • In 2009 the parties fought an edit war on Japanese Wikipedia. The article now follows the 大樋美術館 generation numbering and says "名跡は大樋家から奈良家に移る" (the name passed from the Ōhi family to the Nara family)
